US TM Initial Strategy Session

Service Description

Prior to the session, you will be asked to provide specific information about your business, brand(s), products, services, marketing practices and the evolution of your brand(s), goods and/or services in preparation for the appointment. During the strategy session, you will be provided with 1) the distinctiveness assessment, 2) the results of the preliminary search, 3) a preliminary assessment of the trademark's weaknesses, 4) any risk factors that may prevent registration, 5) a walkthrough of the trademark process, 6) a recommended filing strategy and 7) next steps for your filing project. The rough agenda for the session is as follows: - Whether your trademark(s) is/are registrable - Relevant Nice Classifications - Whether the application will be blocked by prior trademarks - Whether the Registration would be worthwhile in a crowded field - Timing/Length of Use Considerations - Whether the trademark(s) has/have been or will be used in a trademark manner - Will the application provoke a claim? - Project budget After the session, you will be provided with a memo documenting the results of your preliminary search, any concerns about your brands, and a filing strategy with next steps. You'll receive your consultation agreement, consultation invoice and conferencing details after booking. Your appointment is not confirmed until the agreement is signed and payment is rendered. At the time of your appointment, multiple members of your team may join the session. Please note that all sessions are recorded for the client file unless otherwise instructed.
